TERMS &
CONDITIONS
1. All deposits and
payments are non-refundable, in the event of a date change or cancellation for
any reason.
3. The balance owed must
be paid on the date of the session and before any photographs will be
processed.
3. Portrait CD will be
held until any check payment clears.
4. Portrait CD will be
available approximately two-three weeks from the session date.
5. If Katie LaDota is
unable to perform to the guidelines of this contract due to any cause beyond
the control of the parties, Katie LaDota shall have no further liability with
respect to the agreement. If Katie LaDota is unable to perform to the
obligations in this contract for any other reason, Katie LaDota will not be
liable for costs in excess of the amount the client has paid. This limitation
of liability will also apply in the event that the high resolution digital
files are lost through camera malfunction, damaged in processing, lost in the
mail, or otherwise damaged or lost with or without fault of the photographer,
Katie LaDota. While every attempt is made to create the best images possible,
no particular photo is guaranteed.
6. In the event of Katie
LaDota’s illness, other unforeseen circumstance or scheduling conflict, the
photographer Katie LaDota may substitute another competent photographer to take
the photographs.
7. Images may be used for
personal use only, and may not be sold or published without the written consent
of Katie LaDota.
8. All rights to the
images created by Katie LaDota will remain with the photographer. Katie LaDota
reserves the right to display any photographs made in conjunction with this
session as samples of her work for the purpose of window and showroom exhibit,
stock photography, editorial, advertising, promotion on the internet,
publication, instruction and professional competition.
9. Katie LaDota Photography is not responsible for any prints outside my professional lab.
10. Any changes to this
Agreement must be in writing and signed by both parties. This Agreement
incorporates the entire understanding of the parties and is governed by the
laws of the State of New York.
